♡ Comm's Terms of Service {TOS}

♡ Basic Information/TOS

♡ General Terms
By commissioning us, you agree to the terms stated within this document. For clarity, “us”, “we”, and “our” refers to the singular artist; “you” “your” refers to the client.
You agree that you are at least 18 years of age at the time of commissioning us.
Failure to follow the terms of this TOS will result in immediate cancellation of the commission.
Changes may be made to these terms only when agreed upon in writing by both parties before completion of the commission.♡ Rights
We reserve the right to refuse service to, and blacklist anyone, especially those who support MAGA, Trump, Racism, Bigotry, anti-LGBTQ+, and similar harmful political views and ideologies.
Other things that will likely result in a denial of service include, but are not limited to: A lack of visual references, provided references including AI generated images {Only exception is if you were scammed}, Minecraft skin references, and similar.
We also reserve the right to refuse service to any clients that request for style mimicry, or any content that we are not comfortable with creating.
By commissioning us, you acknowledge that, outside of a Non-Disclosure agreement, we have the right to display the commissioned artwork in personal and commercial contexts. The contexts in which we may use the artwork include, but are not limited to, social media posts, advertisements, commission samples, and similar.
Without permission from you, we will not use the commissioned artwork in certain commercial purposes, such as those intended to directly profit from a reproduction of the art, like merch, prints, etc.♡ Payments
We do not accept ECheques, or payments using PP’s “Friends & Family” setting. You must submit payment using either payment option on VGen’s platform {PP or VGen Payments}. All payments must be made in full within 24 hours of sale, before we begin working on the requested commission. Extra time to make the payment may be requested and agreed upon by both parties within the 24 hours.♡ Process
All commissions have a guaranteed delivery date, whether that date is requested by you, or estimated by us. If the deadline was requested by you, you are expected to reply to requests for revisions or approval within 7 days, or the request will be automatically approved and the next phase of the commission will be started, or the commission will be marked as completed if there are no more phases left.♡ Licensing Fees
There are no additional fees required for personal uses; Steaming content, also refer to “monetized/branding uses”, always have an additional fee of +150% {unless stated otherwise}; Merchandise, or “commercial use”, always have an additional fees of +300%.If you wish to publish our WIPs {with proper credits} in any way, an additional +150% fee is required. If you aren't content with this section’s rule please do not publish our work as you do not have permission to do so nor should you be commissioning us, along with receiving no form of refund if you ignore/break this. We have the right to decline, refuse any commission, service if the user failed to follow our TOS.♡ Changes/Revisions
Simple or minor revisions/change during sketch are allowed, however if the changes are majority to the point of beyond the original works then extra fees will be applied. Similarly any major changes during lineart and/or colouring/rendering stages are NOT allowed. Please take time to check twice during the sketching phase before moving on.♡ Reposting
Any reposted commission works on your account are permitted only with proper credits statements, such as in description, title, etc. This will also apply to all social apps such as ToyHouse, Tumblr, Twitter, Instagram, etc.♡ Existing OC Art Permission
If we drew your OC before you decided to resell, trade, gift them away, we give you instant acceptance as it is your OC. So no need to ask us in advance if it’s okay, just as long as it’s originally your OC and not intended to be an adopt from the start without giving us acknowledgement beforehand.♡ Turn around time [TAT]
Normally we take a week maximum to complete a piece, however under certain circumstances we will let you know if there will be any delays. Lack of communication doesn't account for long TAT, it is up to the user to maintain a good and responsive communication, failing to do so may result in slower completion.♡ 🚫Prohibited🚫
All in the list below will always result in a blacklist and block from us.
Under ANY circumstances should you claim our works as “your own doing” will result in us issuing warnings to other artists on our socials.
If you cancel or ghost us during the process of customs after providing payment, they will be redistributed into a new adopt for sale to make up for losses.
Under no circumstance do we offer refund or revisions, changes after the final product.
If you cancel or ghost us during the process of regular commissions, they will be redistributed into a new limited YCH to make up for losses.
Any content involving “NFT” and “AI”, including reselling them as NFT or feeding our work to AI, are ALL PROHIBITED. This is under protection of our TOS, we won't hesitate to take any legal action if need be.

♡ YCH Terms of Service {TOS}

Ghosting or scamming a YCH after payment requested is sent will result in being blacklisted and blocked. Small changes are allowed, however major changes are strictly against our TOS, and you will be charged extra for doing so, fees will depend on amounts of total changes and/or how big they are.

♡ Adopt Terms of Use {TOU}

By adopting {or getting a custom of} any character from us, you have automatically agreed to our Terms of Use as well there will be no refunds to what you buy in our shop {or any customs you order from our services}.

A reminder that if you buy with monetized/merchandise rights it is not considered copyright.

Whether it was a bought adopt, traded for adopt, or a freebie, the creator of the original design must always be credited back to us. While you can fully redesign them to your hearts content it’s advised to keep the original design in their profile/folder, as well as us as the original creator for the original design that started it all. Please do not remove us from the credits of the original design.

If you get a custom/adopt for free, by trade, or by buying one from us, do not instantly gift/trade/sell it away before putting at least one {1} new artwork into them minimum. This does not include the artwork you were given from the design's original freebie, trade, or sale.♡ What NOT to do with our Adopts/Customs:
While it is normally assumed we do not control your new character, as it belongs to you now, we would still like you to follow these rules. As we do not want to be associated with these sorts of things:- Feeding it to AI
- Turning them into NFTs
- Minors drawing suggestive and sexual NSFW {gore is okay}
Drawing underaged-deemed designs in sexual/suggestive artwork
- Hateful content {MAGA, Racism, homo/transphobia, etc.}
- Messed up fetishes/kinks {Scat, Vore, Diapers, etc.}
- Incestuous content
- Pedophilic content
- Detailed feet {Sorry, we’re just highly uncomfortable with it}♡ Creator/Designer’s Adopt Info
Attempting to issue a fraudulent refund {a scam} after the adopt been bought will lead to losing all rights and we will resell them again. If caught continuing using the adopt, we will have to hire legal services with rights.
As we do not offer refunds on any of our products, we also do not offer any sort of “holding” or “claiming” adopts for a certain amount of time. Please have cash ready and only purchase from us when you can. This is first come first serve.
Once brought you will have rights to the adopt as we do not take any authority on your character as long as you don't break our TOU.
